BUYER
The name, surname, delivery and billing address, email address, and contact information provided during the order are taken as basis.

2. Subject of the Contract

The subject of this Contract is the determination of the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law No. 6502 and the Distance Sales Contract Regulation, regarding the sale and delivery of the product ordered by the BUYER electronically through the dimuem.com website.

By approving the order, the BUYER declares to have read the Preliminary Information Form and accepted all the terms of this Contract.

3. Product Information Subject to the Contract

The name, quantity, selling price including VAT, shipping fee, payment method, and delivery information of the product subject to sale are included in the order summary and invoice sent to the BUYER and are an integral part of this Contract.

The products are single-use hydrogel facial masks and hydrogel eye patches. They are cosmetic products and are not intended for the diagnosis, treatment, or prevention of diseases.

Shipping fee: 65 TL for shipments within Turkey, and the equivalent of 3 USD for shipments to the United States and the United Arab Emirates. The shipping fee is shown separately in the order summary and added to the total amount.

4. General Provisions

  • The BUYER accepts that they have been informed about the basic characteristics of the product, the sales price including all taxes, the shipping fee, payment and delivery conditions, and the right of withdrawal before placing the order.
  • The product is delivered to the address provided by the BUYER via the contracted shipping company.
  • If the product is to be delivered to a person other than the BUYER, the SELLER cannot be held responsible if the recipient does not accept the delivery.
  • The SELLER is responsible for delivering the product subject to the contract in sound, complete, and in accordance with the advertised specifications.
  • If the SELLER realizes that they cannot supply the product subject to the contract for a legitimate reason, they shall notify the BUYER within 3 days from the date they learn of the situation and shall refund all payments made within 14 days at the latest.

5. Delivery

  • Countries of delivery: Turkey, United States, and United Arab Emirates
  • Order preparation time: 1–3 business days
  • Estimated delivery time: 1–3 business days after shipment (may take longer for international shipments)
  • Maximum legal period: 30 days from the date of the order
  • Shipping company: Yurtiçi Kargo
  • Shipping fee: Belongs to the BUYER (65 TL for domestic shipments; equivalent of 3 USD for USA and UAE)

For international shipments, customs duties, fees, and similar public charges that may arise in the destination country belong to the BUYER and are not included in the order total.

In case the delivery time is exceeded, the BUYER may terminate the contract. In case of termination, the SELLER shall refund all collected payments within 14 days at the latest. Periods may be extended during public holidays and intense campaign periods.

6. Payment Method

Payments are made online by credit card or debit card. Transactions are carried out through the PCI DSS compliant iyzico payment infrastructure; card information is not seen or stored by the SELLER. All collections are made in Turkish Lira.

For installment payments, the bank's interest difference and commission conditions apply. In the event that the card is found to have been used by unauthorized persons and the amount is not paid to the SELLER by the bank, if the product has been delivered to the BUYER, it must be returned.

7. Right of Withdrawal

The BUYER has the right to withdraw from the contract within 14 (fourteen) days from the date of receipt of the goods, without giving any reason and without paying any penalty.

The right of withdrawal is exercised by sending a written notification to info@dimuem.com within the specified period. The product price and, if any, delivery costs are refunded within 14 days at the latest from the receipt of the notification. The refund is made to the method used during payment; the bank's reflection period to the account is beyond the SELLER's control.

In case the right of withdrawal is exercised, the return shipping fee belongs to the SELLER. For returns made from abroad, shipping and customs costs belong to the BUYER. Return address: Acarlar Mah. Acarkent Sitesi, Dimuem Ofisi, Beykoz/İstanbul

8. Cases Where the Right of Withdrawal Cannot Be Exercised

Pursuant to Article 15 of the Distance Sales Contract Regulation, the right of withdrawal cannot be used for products whose protective elements such as packaging, tape, seal or package have been opened after delivery and which are not suitable for return due to health and hygiene reasons.

Hydrogel masks and eye patches are single-use, hygienic products that directly contact the skin. Accordingly:

  • Products whose outer box has been opened but whose individual sachets have not been opened will be accepted for return.
  • Products whose individual sachet has been opened, torn, or whose seal has been broken will not be accepted for return.
  • In 5-packs, unopened sachets will be accepted for return; the cost of opened ones will be deducted from the refund amount.

This limitation does not apply if the product is defective. This article is identical to the relevant provisions in the Shipping and Return Policy and the Preliminary Information Form.

9. Default and Legal Consequences

In the event that the BUYER defaults on payments made by credit card, the BUYER agrees to pay interest within the framework of the credit card agreement with the card-issuing bank and to be responsible to the bank. In this case, the relevant bank may resort to legal remedies; the BUYER is responsible for any expenses and attorney fees incurred.

In the event that the SELLER fails to fulfill its performance, the BUYER may exercise its optional rights under Law No. 6502.

10. Resolution of Disputes

In disputes arising from this Contract, the Consumer Arbitration Committees and Consumer Courts are authorized in accordance with the Consumer Protection Law No. 6502.

Applications can be made to the arbitration committee or court in the BUYER's place of residence or where the transaction took place. The monetary limits for the jurisdiction of arbitration committees are re-determined annually by the Ministry of Commerce and announced in the Official Gazette.

11. Effectiveness

This Contract is deemed to have been established and entered into force upon its approval by the BUYER electronically. A copy of the Contract is stored in the BUYER's membership account and sent to their email address with the order confirmation.
